1. Introduction

Welcome to Mochi Templates(“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website at mochitemplates.com and the purchase of digital products including but not limited to website templates, themes, web pages, ComfyUI workflows, n8n workflows, and other digital assets (collectively, “Products”).

By accessing our site, creating an account, or purchasing a Product, you agree to be bound by these Terms. If you do not agree, please do not use our site or purchase our Products.

2. Definitions

  • “Products” refers to all digital goods offered for sale on our site, including templates, themes, web pages, workflows, and other digital assets.
  • “Purchase” means the transaction by which you acquire a license to use a Product.
  • “Site” refers to the website operated at mochitemplates.com.
  • “User,” “you,” “your” refers to the individual or entity accessing the Site or purchasing Products.

3. Eligibility

By using our Site, you represent that you are at least 18 years of age or the age of majority in your jurisdiction. If you are using the Site on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

5. Products & Pricing

We make every effort to display accurate descriptions, screenshots, and previews of our Products. However, we do not warrant that the descriptions, colors, or other details are completely accurate, complete, or current. Prices are listed in United States Dollars (USD) and are subject to change without notice. We reserve the right to modify or discontinue any Product at any time.

6. Payment

All payments are processed securely through our third-party payment processor, Polar. We do not store or have access to your full payment card details. By making a Purchase, you authorize Polar to process your payment in accordance with their terms and privacy policy. You agree to pay all fees at the prices then in effect for your Purchase.

7. Digital Delivery

Upon successful payment, you will receive access to download your purchased Product via a secure download link available in your account. Delivery is instantaneous. Download links are temporary and may expire; however, you may request a new link from your account at any time after purchase.

8. Refunds & Returns

Due to the digital nature of our Products (instant access upon purchase), all sales are final and we do not offer refunds or exchanges. If you are a consumer in the European Union, you may have a right of withdrawal within 14 days of purchase under the EU Consumer Rights Directive, which is waived upon your express request and acknowledgement that the digital content is delivered immediately. By completing your purchase, you explicitly consent to the immediate delivery of the digital Product and acknowledge that you lose your right of withdrawal.

Exceptions may be made at our sole discretion in cases of technical issues preventing download or defective files. Please contact us at mochitemplates@gmail.com if you experience any issues.

9. License & Intellectual Property

When you purchase a Product, you receive a non-exclusive, non-transferable, worldwide license to use the Product for personal or commercial projects. You do not acquire ownership or copyright of the Product itself. All intellectual property rights remain with Mochi Templates or its licensors.

Permitted uses include:

  • Using the Product for personal projects
  • Using the Product for commercial projects for yourself or your clients
  • Modifying the Product to suit your needs

Prohibited uses include:

  • Reselling or redistributing the Product as-is or in a substantially similar form
  • Sharing, sublicensing, or transferring your license to another person or entity

  • Claiming ownership or authorship of the Product itself
  • Using the Product for illegal or misleading purposes

These license terms apply to all Products, including templates, themes, web pages, ComfyUI workflows, n8n workflows, and any other digital assets purchased from our Site.

These Terms shall be governed by and construed in accordance with the laws of the United Mexican States, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

15. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Site shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the competent courts of Mexico City, Mexico. Nothing in this section prevents us from seeking injunctive or equitable relief in any jurisdiction.
